12-Month Index Product Agreement

1. Overview
This agreement establishes the terms under which you, the Customer, will receive energy supply services on an index pricing basis through NACC and its supply partner, Active Business Services ("Active"). By accepting this agreement, you are enrolling in a 12-month index product arrangement.
2. Index Pricing
Under this arrangement, your electricity consumption will be priced at the prevailing Alberta pool price (index rate) as published by the Alberta Electric System Operator (AESO). This is a variable rate that fluctuates based on real-time market conditions.
3. Term
The initial term of this agreement is 12 months from the date of acceptance. The agreement will automatically renew for successive 12-month periods unless terminated by either party with 30 days written notice prior to the end of the current term.
4. Hedge Eligibility
As a participant in the index product, you are eligible to request fixed-rate hedges through the NACC platform at any time during your agreement term. Hedge requests are subject to credit approval and market availability. Details of the hedge process are available on the NACC platform.
5. Load Release Authorization
As part of this agreement, you may be asked to sign a Load Release Form (LRF) authorizing your local distribution company to release historical usage and billing information to Active. This information is used to evaluate your energy consumption patterns and provide pricing.
6. Credit Assessment
Active may perform a credit assessment as part of the onboarding process. This assessment is used to determine eligibility for energy supply services and hedge products.
7. Fees and Billing
Billing details, including any applicable fees, margins, and payment terms, will be outlined in the service agreement provided by Active.
8. Termination
Early termination of this agreement or any associated hedge positions may result in mark-to-market exposure costs as outlined in the Active service agreement. Please review the terms carefully before committing to fixed-rate positions.
